These Terms of Service ("Terms") govern your use of websites, products, and services provided by WaveSpark LLC ("WaveSpark," "we," "us," or "our"). By accessing or using our services, you agree to these Terms.

1. Eligibility and Acceptance

You represent that you have the legal capacity to enter into these Terms. If you use the services on behalf of an organization, you confirm you are authorized to bind that organization.

2. Services

WaveSpark provides AI-enabled applications, including but not limited to pose analytics, conversational agents, and image/video processing tools. We may update, improve, or discontinue parts of the services at any time.

3. Account and Access Responsibilities

You are responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account. You must promptly notify us of any unauthorized use.

4. Acceptable Use

• You may not use the services for illegal, harmful, or fraudulent activities.
• You may not upload content that infringes intellectual property rights.
• You may not attempt to disrupt, probe, or compromise service integrity or security.
• You may not use the services to generate prohibited or abusive content.

5. Intellectual Property

WaveSpark retains all rights, title, and interest in and to its services, software, branding, and related materials. Except as expressly granted, no rights are transferred to you. You retain rights to content you lawfully submit, subject to rights required for us to operate the services.

6. AI Output and Limitations

AI-generated outputs may be probabilistic and may contain inaccuracies. You are responsible for reviewing outputs before relying on them in business, legal, medical, financial, or safety-critical contexts.

7. Fees and Payments

If paid features are offered, applicable pricing and billing terms will be provided at purchase or contract time. Unless otherwise stated, fees are non-refundable.

8. Disclaimer of Warranties

Services are provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, WaveSpark LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill arising from use of the services.

10. Indemnification

You agree to indemnify and hold WaveSpark harmless from claims, damages, and expenses resulting from your misuse of the services, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate access if you violate these Terms or if required to protect the services, users, or legal compliance. You may stop using the services at any time.

12. Changes to Terms

We may modify these Terms periodically. Updated versions will be posted with a revised effective date. Continued use after updates constitutes acceptance.
